This site is a clickable timeline of HOA, legal and county records pertaining to a 2020-2022 residential movement to increase solar access in Summers Walk neighborhood (Davidson, NC) that eventually succeeded. The intention of sharing these records is so that similar situations might be prevented from repeating.
- 200 signed consent forms (representing >67% of homeowners) were collected in-person. The HOA stated homeowners were ‘potentially mislead’, and instead proposed to sponsor a Solar Survey for direction, which ignored the signed consent forms.
- It took three Solar Survey audits for the HOA to accurately count the result. The result was also in favor of the solar movement, and was never announced via email to the community.
- Instead of quickly settling a lawsuit, the HOA ignored their own Solar Survey, ignored 200 homeowner-signed consent forms, and made no change to the HOA Solar Policy.
- An 11-month lawsuit ensued. At all times the legal disagreement would be dismissed by a Solar Policy change. After the HOA Board changed the Solar Policy changed and the Lawsuit was dismissed.
